(Prestige Surplus Division)
Prestige Operations LLC (“Company”), including its Prestige Surplus division, may act as an independent broker between buyers and sellers of industrial, electrical, construction, and surplus equipment. The Company may assist in sourcing, negotiating, marketing, and reselling equipment at Fair Market Value based on industry standards, availability, condition, and current market demand.
Broker Compensation
The Company may earn compensation through, including but not limited to:
- Fair market value resale pricing
- Markups
- Price differentials
- Buyer or seller premiums
- Broker commissions
- Assignment of purchase rights
Fair Market Value (FMV)
The resale price offered to buyers is based on Fair Market Value, which may be higher than the acquisition cost. The Company evaluates FMV by considering factors including, but not limited to:
- Condition of the equipment
- Age and hours
- Brand and model
- Current market supply and demand
- Recent comparable sales
- Testing, handling, and logistics costs
Confidential Business Information
The Company is not required to disclose its acquisition cost, margins, markups, commissions, or profit structure to buyers or sellers. This information is considered confidential business data belonging solely to Prestige Operations LLC.
Independent Intermediary
The Company operates as an independent intermediary, not as an agent, fiduciary, or legal representative of any party unless explicitly stated in a signed written agreement.
All pricing presented to buyers represents the Fair Market Value resale price, determined at the sole discretion of Prestige Operations LLC.
Acknowledgements
Sellers acknowledge that Prestige Operations LLC (and its divisions) may resell equipment at a Fair Market Value that exceeds the seller’s asking price.
Buyers acknowledge that Prestige Operations LLC (and its divisions) may include broker margins or sourcing fees in the resale price.
Corporate Entity
All brokerage and resale activities are conducted under Prestige Operations LLC, which holds all legal liability and protection associated with such transactions.
